A LIMITAÇÃO DA JORNADA DE TRABALHO COMO REQUISITO PARA A GARANTIA DO TRABALHO DECENTE

Abstract

Resumo: O presente artigo trata da limitação da jornada de trabalho como um dos pressupostos para assegurar o trabalho decente, fazendo uma análise sobre a violação deste direito e suas consequências para as justas condições de trabalho. A partir de um estudo teórico-normativo, com base no método dedutivo, examina-se a limitação da jornada de trabalho como um direito fundamental do trabalhador. Posteriormente, aborda-se a questão do trabalho decente, explorando seu conceito e os preceitos basilares para as justas condições de trabalho. Na sequência, discutir-se-á como a violação à limitação da jornada de trabalho fere a garantia do direito ao trabalho decente. Por fim, conclui-se que a limitação da jornada de trabalho é requisito fundamental para garantir o trabalho decente, de modo que a violação desse limite configura grave ofensa às justas condições de trabalho e impedimento para a efetiva garantia do trabalho decente.

Abstract: This article deals with the limitation of working hours as one of the prerequisites for ensuring decent work, analyzing the violation of this right and its consequences for fair working conditions. From a theoretical-normative study, based on the deductive method, the limitation of working hours is examined as a fundamental worker right. Subsequently, the issue of decent work is addressed, exploring its concept and the basic precepts for fair working conditions. Next, it will be discussed how violating the working day limitation violates the guarantee of the right to decent work. Finally, it is concluded that limiting working hours is a fundamental requirement to guarantee decent work, so that violation of this limit constitutes a serious offense against fair working conditions and an impediment to the effective guarantee of decent work.
